What is the statute of limitations on Identity theft in California?

In 2005 My little bro. decided to use my personal I.D (drivers license) when he got pulled over for a traffic violation. This happened a few more times in 06,07 and stopped in 08. I filed a police report maybe two months ago 6-2011 and would like to know what the statute of limitations is on this crime and how much jail time if any. This all happened in the State of California

The laws over insurance repairs and frauds prevention how it works?

I mean we all know that whoever faults at accident gonna pay for repairs from their insurance.

However my questions is what if I buy used car that have little damages on it. As I drive on road, maybe a month later somebody cause accident to my car and police rule out it’s their fault.

So how can their insurance pay for my car repair from new accident if I already have damages on my car before I buy them?

According to a law, once accident happened the insurance only pay for repair from new damages not from old damages. It’s insurance fraud if they pay for whole repair that is not part of their causes.

Example: I buy a car with rear bumper damages, just little paints and dents on rear bumper. When the accident happen, it cause rear bumper to fall off and it needed new bumper, how can insurance pay for new bumper if some of it was already damages when I buy those car?

They might write off but if car is value at 10K and cost repair is 800 dollars then it cheaper to fix but how? How without insurance fraud?

Why do we need to carry and show social security cards as they are not photo IDs and invite identity theft?

In applying for a marriage license, I am required to show a social security card. My fiancee can’t find hers, so what’s to stop me from forging one on a computer, or anyone else for that matter? Why is do much importance given to such an easily forged and damages document? If they were made more like drivers licenses with security features, I might value it more.

Debit Card Fraud…Refund?

I was notified by visa fraud prevention center that someone in Colombia in South America has made a counterfeit debit card and used a valid pin to withdrawal $200 six times in one day ($1200 Total) I haven’t even been there before and I have my card with me all the time. They canceled my debit card, told me to go to the bank, fill out a form, and that they’ll look into it. My question is, are they more than likely to refund my money?.,,

Is it bad if your bank calls you b/c you spent too much money on your credit card?

I got a call about fraud prevention. I spent like $2000 on a new laptop and I started being bombarded with phone calls? Should I not have spent this much? Will they take away my credit?

I haven’t even reached the limit on my card so I was a little surprised by the response that I went ahead and canceled my order even though I really need a new computer.

Paypal needs tracking verified to credit **SCAM??**?

i hhad a long conversation with this person on craigslist and i got 2 legit emails (or so i think) that say for protection of both the sender and the receiver, paypal is holding the money until i ship the item and confirm through tracking, the address was from ” service@paypal.co.uk ”

HOW DO I CLEAR MY NAME WITH A FORMER EMPLOYER?

This past January I was working for a local Credit Union. I was only a month and two weeks on the job and in my probationary period when I had a significant teller difference. I was terminated from the job for having a teller difference that could not be recovered in a forty-eight hour time period. The fraud investigator accused me of taking/borrowing the money based on a fabricated, laughable story to give reason to her belief that I would steal the money. She also did a hard inquiry on my credit report without my permission. She claimed there was ‘questionable activity’ on the video tape, and when I asked for her to show to me what she thought was questionable, she refused and said, “I don’t have to because it is Credit Union property”.

Recently I had to file a claim with my credit card company to use the insurance protection I have on my account in case of death, sickness or involuntary unemployment. My former employer had to fill out a portion of the form, so I sent off the part of the form that only had to be completed by them.

Someone in HR filled out the form, sent me a photocopy of the completed form and sent off the original to my credit card company, which I had asked to be sent back to me because the form was two parts and not one. That pissed me off because whoever filled out the form didn’t follow the directions I sent to them. And on the form for the reason I was terminated, the HR representative put “$XXXX missing from cash box” instead of just putting “Teller difference”.

I am worried because the representatives at my credit card company may read the reason I was terminated and assume I was terminated for stealing, which would affect my claim.

I am wondering if I need to obtain an attorney to clear my name with this employer because I feel that they are still falsely accusing me of theft. I also feel that it was malicious on the part of the HR representative to put “XXXX missing from cashbox” instead of “Teller difference” for the reason of my dismissal because of this false belief.

What do I do?
I have excellent credit actually. My credit is in the 700 range, I have never made any late payments,or defaulted on anything, so my credit is no problem. I consented to a credit check when I was first hired and I don’t recall signing anything to where they can pull my credit any time they feel.

The reason I am asking if I need an attorney is because the fraud investigator falsely accused me of taking the money. When I asked her to prove to me her allegations, which are untrue, she refused to do so.

I didn’t steal anything. I had a teller difference and their policy is to only investigate for forty-eight hours. My career in banking isn’t over when I have never done anything wrong to begin with.

Has anyone else been affected by third party collection agencies?

In 2006, my husband and I filed chapter 13 bankruptcy. We were living to next to nothing during that period. I had to quit my job as a nurse aide because of a shoulder injury so that impacted our budget pretty hard. We paid all of our bills on time and still had a little money left over. In April 2007, our plan was confirmed and we had no debt except the court payments and regular bills. July 2007 we moved from a rental unit to an apartment which was much closer to my husband’s job. Gas was close to $4 a gallon and the transportation costs were sky high. We always had problems receiving our mail at our old unit. We received other resident’s mail and vice versa.
I was concerned the first few months at living at our current address because we received very little mail. I finally contacted all of my utility companies and car insurance only to find out that all of my mail was being mailed back to them. I managed to clear up the mess, but important bills were now a few months late and we had to make payment arrangements with all the companies involved. We had two catalog companies that I bought my clothes through sometimes and had a small line of credit with them. I paid all of these companies off eventually.

In 2009, we received a letter from a debt collector stating we had an open credit card. I asked them to verify the debt. I never received any letter back from them. They kept on sending out bills though but couldn’t verify the debt. I sent the letters to my bankruptcy attorney and the bills stopped. A few months passed, another collection agency, same debt. Same thing happened as the first. Six months later, another collection agency, same debt, same response. Never heard from any of these collection agencies again. I finally got fed up and put a fraud alert on our credit report. The alert was released in January, guess what a new collection agency contacted my attorney regarding the same old credit card. I talked to someone at our attorney general’s office, the fact that they don’t have our old address is suspicious because we never have taken out any credit cards since filing the chapter 13. This is why I’m suspecting ID theft. I checked my credit report just last Saturday and found another credit card that couldn’t be mine. So this makes 2 suspicious cards that probably aren’t ours because we never applied for any cards. What can you do to stop the possible ID theft credit card from being acquired by other junk or third party debt agencies? Has anyone else dealt with ID theft? We are currently under bankruptcy protection so I believe that no one can sue us. I did find out that the credit card holder wrote off this debt as a bad debt. We have never ever been contacted by the original creditor. Thanks
I just filed a complaint with the FTC about the credit issues. The counselor suggested contacting my local police and filing a police report with almost certain ID theft. You think it can’t happen to you! I had horrible credit and still someone managed to get credit off of my poor credit rating. I probably now will have to take steps to clear up the ID theft. I will never, never ever use credit cards again. Look what they’ve done to our country. Thank you for all of your answers.
