will i or can i get jail time in illinois for identity theft?

i was driving and i was scared so i got stopped for speeding and my license was already suspended and so i panic and gave my girlfriend name and birthday and they are now talking about pressing charges on me for identity theft and other charges but i’m not in the same state anymore what should i do i’m scared

    It is not identity theft according to Illinois state law. It is “interfering with a police officer in the line of duty by providing false information during an investigation”. However, if the ticket went warrant for failure to appear, and your girlfriend got arrested for that (you used her ID). Then she can have a civil lawsuit against you for libeling her name.

    What you should do is hire a lawyer, have the lawyer contact the courts and clear up the mess. It is not just the legal thing to do, it is the right thing to do for your friend.
